Rental Agreement

​

General Terms and Conditions: It is hereby agreed that the listed /attached equipment is rented from Celebration Station Event Rentals by the customer for the customer's own use. The equipment will not be loaned, sublet, mortgaged or in any other manner disposed of by the customer. The customer agrees to be liable for any loss of equipment by fire, theft or any other cause. Once the equipment has been accepted, either verbally or by signature, Celebration Station Event Rentals will not be responsible for inclement weather and/or any other conditions which may cause the delay or cancellation of an event.

Inspection: The customer acknowledges that he/she has had an opportunity to personally inspect the equipment and find the equipment in good condition that is suitable for his/her needs. The customer further acknowledges that it is his/her duty to inspect the equipment prior to use and notify Celebration Station Event Rentals of any defects. The customer also agrees to inspect the equipment periodically during the event.

The item displayed in the picture may vary in colour. Customers will receive a similar item that may differ in colour but have the same functionality.

Event Reservation:  A signed rental agreement and a non-refundable deposit of fifty percent (50%) of the total rental price are required to reserve a date for an event.  Should the rental be cancelled for a reason not addressed in this rental agreement, the customer will forfeit the deposit.

​

Rental Period: The standard rental period is for eight (6) hours between 8:00 AM to 8:00 PM of the same day.  The rental time period can be adjusted if requested; all adjustments to the standard rental period must be agreed upon by both parties and specified in the rental information document.  Depending on the time requested, delivery charges and game/equipment rental costs could differ from the rental literature.  The customer is responsible for safely storing the games from inclement weather and preventing damage from the time the equipment is delivered until it is picked up.

 

​Delivery and Pick-Up: The rental items will be delivered at least one (1) hour prior to the scheduled start of the event and picked up at the scheduled end of the event.  The delivery and pick-up times can be adjusted if requested; all adjustments to the standard times must be agreed upon by both parties and specified in the rental information document.

Delivery Policy:  Celebration Station Event Rentals offers free delivery for rental equipment within a 50 km radius of Airdrie, Alberta.

Delivery Charges: For deliveries beyond the 50 km radius, an additional delivery fee will apply. The fee will be calculated based on the distance from Airdrie, Alberta. Please contact Celebration Station Event Rentals for a detailed quote on delivery charges for locations further than 50 km.

Rental Security Deposit: A security deposit will be collected from the customer and held until the games/equipment are picked up and confirmed to be in the same condition they were delivered. This security deposit will be used to repair any damage outside of normal wear and tear, should it occur. The security deposit will be returned within 24 hours to the method of payment used to hold the deposit after the final inspection, when the games/equipment is picked up.

If the total cost of items rented is $250 or under, the security deposit will be $250. If the total cost of items rented is over $250, the deposit will equal the amount of the rental. For example, if the total cost of rented items is $300, the security deposit will also be $300.

 

Security Deposit must be paid before any setup occurs. Payment can be made via e-transfer or a POS terminal.

Final Payment: The final payment in the amount of the outstanding balance is due before any setup and or delivery occurs. The games/equipment will not be delivered and or and set up if the final payment is not received prior to the start of the event. A customer can pay the final balance at the event, prior to set up.  This needs to be arranged prior to delivery.

​

Inclement Weather: In the event of inclement weather during the rental period, it is the responsibility of the customer to move the equipment to a dry location to protect them from water damage.  In the event of inclement weather prior to the start of an event where the venue does not have an indoor contingency plan, the customer will use the deposit towards another event within the next 6 months.

​

Rental Game Unavailable due to Damage or Theft:   Should a game/equipment be unavailable to rent due to damage or theft, the following actions will be taken:

  • An available alternate game will be offered with the rental price adjusted accordingly.

  • A refund will be given for the game that is unable to be rented.

​

Rental Game Denied by Venue: If a game is determined to be unsuited for the venue because it could cause damage to either the venue or the game/equipment itself, the following actions will be taken:

  • An available alternate game will be offered with the rental price adjusted accordingly.

  • A refund will be given for the game that is unable to be rented.

​

Appropriate Use of the Games: The games are intended to be played in a reasonable and respectful manner according to the instructions provided with the games.  The games are not to be misused in a manner which could cause damage, which includes: hanging things from the games, attaching things to the games, standing on the games or equipment, resting drinks on the games, etc.  It is the responsibility of the customer to ensure that misuse does not occur.

Operation of Equipment: The customer agrees that all rented equipment shall be used and operated only by persons competent in its operation. The customer further agrees to operate and maintain/service the equipment in accordance with instructions during the time it is in his/her possession, regardless of rental time stipulated on contract(s) and understands neglect to do so may result in an additional charge and/or loss of deposit. The customer acknowledges he/she understand the proper use of equipment. The customer further agrees not to operate the equipment in a careless or negligent manner.

Wear and Tear: The appearance of the games may be slightly different than in the rental literature because of wear and tear.  The games are subject to wear and tear from normal rental use and may sustain minor cosmetic damage and blemishes during the rental period. The customer is not liable for this type of damage.

​

Repairable Damage: The customer acknowledges that they are liable for any and all repairs required, outside of normal wear and tear, to make the games/equipment available to be rented for the next event.  The condition of each game/equipment will be documented before and after the rental period to justify any repair costs that are charged to the customer.  The security deposit will be used to pay for any required repairs; any remaining security deposit will be returned to the customer, and additional costs exceeding the security deposit will be the responsibility of the customer.

  

Damage Beyond Repair/Theft of Games: Should a game/equipment be damaged beyond repair or stolen by the customer, they will be financially responsible for the replacement of the game/equipment.  Some games are handmade using premium materials, which are both costly and time-consuming to replace.

In addition to the replacement cost of the game/equipment, the customer will be liable for any financial loss sustained until the game/equipment is replaced.  The financial loss will be calculated from scheduled rentals which require refunds and lost rental opportunities because the game/equipment is unavailable.

​

Dispute Resolution: In the unlikely event that a customer is dissatisfied with the rental service provided, they agree to cooperate with Celebration Station Event Rentals to discuss and come to a resolution which satisfies both parties. This can include discounts and or game substitutions.

​

Supervision and Care: The customer agrees to supervise the operation, use and storage of the leased equipment from the time the equipment is put in the customer's possession and/or agreed premises until the time the leased equipment is recovered from the customer's possession and/or agreed premises. The customer further agrees to surrender and return all the equipment leases at the specified herein in the same condition in which it was received, normal wear and tear excepted. If the customer fails to return all the equipment in the aforementioned condition and/or agreed return time, the customer agrees to pay Celebration Station Event Rentals the cost of the repair or replacement of any damaged or lost equipment and/or any late fees to be determined by Celebration Station Event Rentals.  The customer hereby agrees to supervise the operation, use and storage of the rented games/ equipment continuously and hereby assumes full responsibility for any injuries which may result from said operation, use and storage.

Location: The rented equipment shall be at the address specified by the customer, which address appears on the rental agreement, and the customer grants Celebration Station Event Rentals the right to enter the said property.

​

Warranties: There are no warranties of merchantability or fitness, either expressed or implied. There is no warranty that the equipment is suited for the customer's intended use or that it is free from defects. Celebration Station Event Rentals makes no warranty of any said games/equipment, and the customer agrees to notify Celebration Station Event Rentals immediately if any rented games/equipment develops an indication of defect or improper working condition. The customer agrees to use said game/ equipment entirely at his/her own risk and to be liable for any damage to persons, agents, servants, and employees from any and all liability resulting from the operation or use of the rented equipment.

Limit of Liability: Celebration Station Event Rentals and all representatives are only financially responsible and liable for up to, but not to exceed the payments and security deposit received by the customer, for the rental price of the games/equipment during the rental period agreed upon.  The customer acknowledges that they are solely responsible for assuring that their guests are using the equipment/games in a safe and civil manner.  The customer agrees that any and all bodily injuries sustained, up to and including death, are the responsibility of the customer and their guests. The customer and guests indemnify and hold harmless Celebration Station Event Rentals and all representatives involved from any and all legal action.

Warning:
• Follow all operating rules whenever the product is in use.
• Do Not place the product near fire or heating areas.
• Do Not use the product in rain, strong wind or extreme weather
